Welcome to the CADIVEU Online Store
Below we present to you (USER) the Terms of Use and Navigation Conditions, a document that lists the main rules to be observed by all those who access and use the features of the CADIVEU Online Store.
As a condition for accessing and using the COMPANY Online Store, the USER must declare that he/she has read the rules of this document and its Privacy Policy in full and carefully, conferring his/her free and express agreement with the terms stipulated herein.
1. GENERAL INFORMATION ABOUT THE CADIVEU ONLINE STORE
1.1. The CADIVEU Online Store is a digital environment that allows the USER to purchase various types of products online safely and easily, offering a unique browsing experience, with differentiated prices, promotions and delivery and payment methods.
1.2. In order to access the CADIVEU Online Store securely and use its features in full, it is the USER’s sole responsibility to have compatible devices and equipment, an Internet connection service with antivirus and firewall enabled, duly updated software, and to adopt minimum security measures, such as the use of a strong password.
1.3. The CADIVEU Online Store and its features are presented to USERS as they are available, and may undergo constant improvements and updates, with the CADIVEU Online Store being obliged to:
i. Preserve its functionality, with non-broken links and using a layout that respects usability and navigability, whenever possible;
ii. Display the features in a clear, complete, precise and sufficient manner so that there is an exact perception of the operations performed; and
iii. Ensure, through the available state of the art, the confidentiality of the data, which will only be accessible by CADIVEU and by those who the USER consents to, in addition to the USER himself.
1.4. CADIVEU makes every effort to maintain the availability of the CADIVEU Online Store. However, there may be temporary unavailability due to necessary maintenance or even due to force majeure, such as natural disasters, system failures or third-party events that are beyond its control and responsibility.
1.4.1. If this occurs, the CADIVEU Online Store will do everything in its power to restore access as soon as possible, within the technical limitations of its services and third-party services, on which the CADIVEU Online Store depends to remain online.
1.4.2. Any maintenance procedures that result in the unavailability of the CADIVEU Online Store for long periods will be communicated through its official communication channels.
The CADIVEU Online Store may experience occasional temporary unavailability for reasons beyond our control, but we will do our best to restore it as soon as possible.
2. FUNCTIONALITIES OF THE CADIVEU ONLINE STORE
2.1. In order to purchase products from the CADIVEU Online Store, the USER must have an Access Account, which can be created by filling out a form by the USER or by linking it to an existing Facebook or Google account.
2.2. The services of the CADIVEU Online Store are intended for individuals over 18 (eighteen) years of age and fully capable. If the USER does not agree with the requirements, he/she must not proceed with the creation of the Access Account or use its services without the presence of a legal guardian, under penalty of being characterized as bad faith.
If the USER is an individual, he/she must be over 18 (eighteen) years of age to use the CADIVEU Online Store.
2.3. The CADIVEU Online Store may change its eligibility criteria for access and use at any time, without having to communicate or notify USERS in advance.
2.4. CADIVEU reserves the right to include and remove new (or existing) features and tools from the CADIVEU Online Store at its convenience, whenever it deems necessary to offer the best services and products to the USER.
2.5. CADIVEU has the right to refuse to grant or cancel the Access Account of any person who uses it fraudulently, violates or attempts to violate these Terms of Use and Conditions of Browsing, the Privacy Policy, other policies or any legal document of CADIVEU.
2.6. If at any time it is found that the USER has provided false or unrealistic information, the CADIVEU Online Store reserves the right to cancel their Access Account, without prejudice to adopting any measures it deems appropriate.
The CADIVEU Online Store may cancel Access Accounts that have been created with false information or that are being used in violation of CADIVEU’s legal documents.
2.7. USERS who have an Access Account may evaluate and publish comments about the products available in the CADIVEU Online Store.
2.8. CADIVEU reserves the right not to publish or delete comments sent by USERS at any time, without prior notice and without any right to compensation to anyone, that contain:
i. Offense to the honor, image, reputation and dignity of third parties;
ii. Pornography, pedophilia and other forms of sexual gratification;
iii. Racism or discrimination of any nature;
iv. Bullying, stalking or any other type of illegal constraint or harassment;
v. Violation of copyright or image rights;
vi. Use of third-party brands, symbols, logos or emblems;
vii. Instigation or advocacy of crimes, such as drug trafficking or use, rape, homicide, fraud, among others;
viii. Manifestation of the practice of an act contrary to the law, public order or good customs;
ix. Use of violence, dissemination of hatred or any other form of aggression against someone’s physical well-being;
x. Commercial activity similar to that of the CADIVEU Online Store or that uses it to raise funds through third-party advertising instead of practicing regular interaction in the environment; and
xi. Errors or suspected mistakes.
2.9. Comments sent by USERS and published in the CADIVEU Online Store should not be interpreted as CADIVEU’s opinion, nor as a statement of agreement with what was published. USERS are entirely responsible for the comments they submit to the CADIVEU Online Store.
If the CADIVEU Online Store finds comments that contain or address the topics mentioned above, it reserves the right not to publish them or to delete them.
3. RESPONSIBILITIES AND OBLIGATIONS OF USERS
3.1. USERS are responsible and obligated to:
3.1.1. Use the CADIVEU Online Store correctly and ethically, always respecting the conditions that govern its use and purpose;
3.1.2. Provide correct, complete and updated information and registration data, in addition to informing a contact channel that can be used by CADIVEU for the best performance of the services;
Never provide false or incorrect information when using the CADIVEU Online Store.
3.1.3. Maintain the confidentiality of your Access Account data in relation to third parties, not making your password available, disclosing it or sharing it with anyone, under penalty of deletion of the Access Account, in addition to having to compensate for any damages arising from such undue disclosure. If you suspect that the confidentiality of your password has been violated, the USER must change or update it as soon as possible and, if you are unable to access the Internet to obtain support, you must seek assistance through the available channels;
3.1.4. Preserve the individual use of your login, access password and any other forms of verifying the authenticity of the Access Account;
3.1.5. Adopt a strong password in order to make it difficult for computer experts to guess it or crack it using brute force mechanisms. A strong password is understood to be one that:
i. Has at least 8 characters, including 1 uppercase letter, 1 lowercase letter (both without accents) and 1 number;
ii. It does not represent numerical sequences related to personal information or information that is easy to deduce, such as elements of the name itself, commemorative dates or repetition of identical characters, for example, but not limited to: 1234, 0000, 01012011; and
iii. It is not reused in third-party applications, portals and platforms.
3.1.6. Adopt measures on your technological devices to prevent physical and logical access by unauthorized third parties, such as the use of passwords and/or biometrics;
3.1.7. Recognize that all accesses made after your successful digital authentication are interpreted as having been made by you in an indisputable manner. Therefore, you will be responsible for all accesses and operations in the CADIVEU Virtual Store carried out using your Access Account, including those resulting from improper use or disclosure of this to third parties.
Do not share your Access Account with anyone, since the sole person responsible for uses made from these accounts will be the USER himself.
3.1.8. Leave your anti-spam systems, similar filters or message redirection settings adjusted so that they do not interfere with the receipt of communications and materials from the CADIVEU Online Store, and no excuse will be accepted if you have not had access to any email or electronic message due to the aforementioned resources;
3.1.9. Respect all intellectual property rights owned by CADIVEU, such as all rights relating to third parties that may be or have been, in any way, available on the CADIVEU Online Store. Likewise, USERS may only reproduce the content available on the CADIVEU Online Store, especially its brands and environment layout, provided that they are duly authorized by CADIVEU.
